3. SECTION 157 — Metropolitan Planning Committee
Metropolitan Area कब? जहाँ: Population = 10 lakh या अधिक, वहाँ Metropolitan Planning Committee (MPC) constitute की जाएगी।
Exam Formula: MPC = 10 Lakh+
MPC का मुख्य उद्देश्य: MPC पूरे Metropolitan Area के लिए Metro Region Development Plan का draft तैयार करती है।
MPC के Members: MPC में members की संख्या State Government Official Gazette notification द्वारा समय-समय पर तय करती है।
MPC — 2/3 Rule — सबसे महत्वपूर्ण MCQ fact: MPC के कम-से-कम 2/3 members elected होने चाहिए। ये elected members: Municipalities के elected members और Metropolitan Area की Panchayats के Chairpersons में से चुने जाते हैं।
Formula: MPC → ≥ 2/3 Elected
Elected Members का Representation: Municipal areas और Panchayats के representation का ratio उनकी respective population के आधार पर होगा।
Nominated Members: Nominated members में हो सकते हैं: Government of India representatives, State Government representatives, State Government द्वारा identified organisations/institutions के representatives।
Central Government Representative के लिए Special Rule: यदि nominated person Government of India या Central Government organisation/institution को represent करता है, तो nomination से पहले Government of India की prior concurrence लेनी होगी।
MPC के Functions: MPC को Planning और Coordination से संबंधित functions मिल सकते हैं। ये functions State Government द्वारा assign किए जा सकते हैं।
MPC को Additional Powers: State Government powers confer कर सकती है; powers delegate कर सकती है; functions entrust कर सकती है। Purpose: Chapter के objectives को implement करना।
MPC Chairperson: MPC का Chairperson — State Government nominate करती है।
Trap: Chairperson automatically Mayor होगा। ❌
MPC Plan बनाते समय क्या देखेगी? MPC को ध्यान रखना होगा:
1. Municipalities के plans
2. Panchayats के plans
3. Municipalities और Panchayats के common interests
4. Coordinated spatial planning
5. Water एवं physical/natural resources sharing
6. Integrated infrastructure development
7. Environmental conservation

MPC Plan कहाँ भेजती है? MPC द्वारा तैयार Metro Region Development Plan State Government को forward किया जाता है।
4. SECTION 158 — District Planning Committee
Section 158 के अनुसार: Rajasthan Panchayati Raj Act, 1994 की Section 121 के तहत constituted District Planning Committee को Constitution के Article 243ZD के तहत constituted committee माना जाएगा।
Article 243ZD Connection:

5. SECTION 159 — Civic Survey
Municipality को planned एवं integrated development तथा balanced land use के लिए Detailed Civic Survey करना है। इसके आधार पर Master Development Plan और Other Statutory Plans तैयार किए जाते हैं।
Coordination किनके साथ? Municipality coordinate करेगी: Metropolitan Planning Committee या District Planning Committee के साथ। और Chief Town Planner of the State के साथ भी।

याद रखें: 20 – 5 – 1
Master Development Plan: Master Plan long-term spatial/development framework है। इसमें Municipality की future development, public utilities, civic amenities, housing, transportation, natural resources आदि की planning की जाती है।
Execution Plan — Time Horizon: 5 years: Master Development Plan के implementation को operationalise करने वाला medium-term framework समझें।
Annual Municipal Action Plan — Time Horizon: 1 year: यह annual implementation/action level planning document है।
Ward-Level Plans: Master Development Plan, Execution Plan और Annual Municipal Action Plan के अतिरिक्त Municipality प्रत्येक ward के लिए अन्य plans भी बना सकती है। या State Government ऐसा करने का direction दे सकती है।
Master Development Plan में क्या-क्या? Plan में precisely define किया जा सकता है: Roads, Highways, Railways, Canals, Airports/Air Cargo, Bus Services, Water Supply, Drainage, Sewerage, Electricity/Gas, Natural Areas, City Forests, Wildlife, Historical/Architectural/Scientific Sites, Housing, Recreation, Industrial concentration, Redevelopment आदि।
Zoning: Master Development Plan Municipality को विभिन्न zones में divide कर सकता है। प्रत्येक zone में development manner, land use, development stages बताए जा सकते हैं।
Zonal Development Plan: Master Development Plan basic framework का काम करता है। इसके आधार पर विभिन्न zones के Zonal Development Plans बनाए जा सकते हैं।
Zone Alteration: Municipality Public Interest में आवश्यक समझे तो किसी zone का area alter कर सकती है।
Financial Resources Limitation: Master Development Plan में scheme होने का अर्थ यह नहीं कि Municipality को उसे तुरंत implement करना ही होगा। Municipality अपनी financial resources की availability को ध्यान में रखकर schemes undertake कर सकती है।
6. SECTION 160 — Draft Plan
Final Plan बनाने से पहले Draft Plan तैयार करना होगा। फिर copy inspection के लिए उपलब्ध करानी होगी। और public notice के माध्यम से Objections + Suggestions invite किए जाएंगे।
Advisory Committee: Municipality यदि appropriate समझे तो Advisory Committee constitute कर सकती है। इसका काम draft plan पर विचार करना है।
Advisory Committee — Composition:
1. All Municipality Members
2. Industry/Commerce/Trade/Profession associations के representatives
3. Academic institutions के 6 representatives
4. NGOs के 6 representatives
5. अन्य prominent citizens के 6 representatives
Important Number — 6–6–6
Final Approval: Objections, suggestions, representations और Advisory Committee recommendations consider करने के बाद Municipality Plan State Government को approval के लिए भेजती है।
7. SECTION 161 — Plan कब Operate करेगा?
Plan sanction होने के बाद Public Notice publish किया जाएगा। उस notice में: Plan approved है; Plan कहाँ inspect किया जा सकता है; बताया जाएगा। और First publication की date से Plan operation में आएगा।
Exam Trap: Plan operation = State approval date जरूरी नहीं। Statutory trigger: First publication of public notice
8. SECTION 162 — Plan Modification
Plan operation में आने के बाद Municipality State Government की prior approval से modification कर सकती है। लेकिन modification: material alteration in character न करे। और land-use extent या population density standards से संबंधित नहीं होना चाहिए।
Modification से पहले: Municipality notice publish करेगी और objections/suggestions consider करेगी।
Modification कब Operate करेगा? Modification publication date या Municipality द्वारा notice में fixed date से operate कर सकता है।
लेकिन Final Approval? Section 162(5) का important point: State Government की final approval के बिना modification नहीं।
9. SECTION 163 — Implementation
Plan के operation में आने के बाद Municipality Act के provisions के अधीन Plan implement करने के लिए आवश्यक action initiate कर सकती है।
10. SECTION 164 — पुराने Plans
Act के commencement से पहले किसी अन्य law के तहत बनाया गया Master Development Plan इस Act के तहत बनाया गया plan Deemed to have been prepared माना जाएगा। लेकिन नए Act के तहत sanctioned Plan आने पर पुराना Plan Cease to operate कर देगा।
11. SECTION 165 — Review of Plan
Plan के operation में आने की date से 10 years के भीतर यदि State Government या Municipality माने कि revision आवश्यक है, तो State Government Municipality को revision के लिए direct कर सकती है। या Municipality suo motu revision कर सकती है।
Revision के समय: आवश्यक होने पर fresh civic survey और existing land-use map तैयार किया जा सकता है।
Formula: Plan Review → 10 Years
12. SECTION 166 — Development Area
Plan के operation में आने के बाद Municipality State Government approval के साथ Official Gazette notification द्वारा किसी area को Development Area declare कर सकती है।
Development Area में Basic Rule: Notification के बाद कोई व्यक्ति land institute/change use या development नहीं कर सकता: Municipality की written permission के बिना।
Development Area — Exceptions: कुछ activities के लिए permission आवश्यक नहीं है। उदाहरण: Building की internal maintenance/improvement जब external appearance materially affect न हो। Lawful authority order compliance, Municipality के statutory works, Government/local authority के certain road/highway/public utility works, Agricultural operations में ordinary excavation/wells, Agricultural access road, Temporary use का normal use, Occasional alternative use of normally used land.
13. SECTION 167 — Unauthorized Development
यदि कोई व्यक्ति development/use करता है: बिना required permission या permission की conditions के विरुद्ध या permission revoke होने के बाद या modified permission के विरुद्ध तो offence बनता है।
Section 167 — First Category Penalty: Conviction पर ₹5,000 तक fine और continuing offence में ₹100 तक प्रति दिन additional fine हो सकता है।
Section 167(2) — Unauthorized Use: यदि कोई व्यक्ति Plan के विरुद्ध land/building का use continue करता है: तो conviction पर ₹2,000 तक fine हो सकता है। Continuing offence: ₹500 तक प्रति दिन additional fine।
Important Difference:
Unauthorized Development → ₹5,000 + ₹100/day
Unauthorized Use → ₹2,000 + ₹500/day
यह बहुत अच्छा RPSC MCQ बन सकता है।
14. SECTION 168 — Removal Notice
Unauthorized development होने पर Municipality owner को written notice दे सकती है। Notice में compliance के लिए Maximum 1 month तक का period दिया जा सकता है।
Notice का उद्देश्य: Situation के अनुसार: Unauthorized development before-condition restore करना या permission/conditions के अनुसार compliance कराना। यदि notice land-use discontinue करने के लिए है: occupier को भी notice देना होगा।
Notice में क्या हो सकता है? Municipality require कर सकती है: Demolition, Alteration, Building/other operations, Discontinuance of land use.
Owner का Remedy: Notice से aggrieved person prescribed period के भीतर retention permission या continuance of use permission के लिए application कर सकता है। जब तक application finally decide/withdraw नहीं होती: mere notice अपने-आप building/use को affect नहीं करता।
Permission मिल जाए तो? यदि requested permission grant हो जाती है: Notice withdraw हो जाएगा, संबंधित extent तक।
Permission नहीं मिली तो? Notice Continue रहेगा और Municipality required corrective action करा सकती है।
15. SECTION 169 — Unauthorized Development Discontinuance
Section 169 के तहत Municipality unauthorized development को discontinue करने की action ले सकती है। Police assistance भी statutory mechanism में उपलब्ध है और continued unauthorized development पर additional consequences हो सकते हैं।
Continuing Offence: Police requisition के बाद भी unauthorized development जारी रखने पर conviction: Fine up to ₹5,000 और continuing offence: ₹200/day तक additional fine हो सकता है।
No Compensation: Unauthorized development को discontinue करने के कारण हुई damage के लिए Compensation claim नहीं किया जा सकता।
16. SECTION 170 — Temporary Unauthorized Development
Temporary unauthorized development के लिए Municipality written order द्वारा structure/work हटाने या unauthorized land use discontinue करने का direction दे सकती है।
15 Days Rule: Temporary unauthorized development के मामले में 15 days का period दिया जाता है। यदि व्यक्ति comply नहीं करता: Municipality/authorized officer summarily remove/discontinue कर सकता है।
Standing Crops Protection: Temporary unauthorized development removal में Standing crops को summarily remove नहीं किया जाएगा। Crop काटने/इकट्ठा करने के लिए reasonable period: Maximum 6 months तक दिया जा सकता है।
“Temporary Development” कौन तय करेगा? Section 170 के तहत Municipality का decision कि कोई development temporary nature का है या नहीं: Final है।
17. SECTION 171 — Plot Subdivision
यदि कोई व्यक्ति अपना land/plot subdivide करना चाहता है या Private Street lay out करना चाहता है, तो Plan के operation के बाद Layout Plan Municipality को sanction के लिए submit करना होगा।
Municipality क्या कर सकती है? Municipality Sanction या Modified sanction या Conditions के साथ sanction या Refuse कर सकती है।
Refusal का आधार: यदि Municipality माने कि subdivision/private street Plan के proposals के consistent नहीं है, तो sanction refuse की जा सकती है।
Refusal पर Compensation? No compensation — सिर्फ sanction refusal, modification, conditions लगाने के कारण compensation payable नहीं है।
Unauthorized Subdivision: यदि person बिना sanction, sanction की conditions के विरुद्ध, sanction refusal के बावजूद work करता है, Municipality stop-work notice दे सकती है और inquiry के बाद remove/pull down या land restore कर सकती है।
Section 171 Penalty: Notice के बाद भी development जारी रखने पर ₹5,000 तक fine और continuing non-compliance: ₹200/day तक additional fine।
18. SECTION 172 — Recovery of Expenses
Sections: 168, 169, 170, 171 के तहत Municipality ने जो expenses किए हैं: वे Sum due to Municipality होंगे। और Arrears of Land Revenue के रूप में recover होंगे।
19. SECTION 173 — Projects & Schemes
Municipality Plan implement करने या अन्यथा integrated city development के लिए Projects and Schemes बना सकती है।
Scheme में Land Acquisition: Scheme में acquisition, development, reservation, sale, lease of land हो सकता है। Public purposes में: Roads, Streets, Parks, Open spaces, Hospitals, Educational institutions, Housing, Markets, Shopping centres, Commercial complexes, Cultural centres, Administrative centres, Transport facilities आदि शामिल हैं।
Scheme में Redistribution: Scheme Original property owners के sites का Redistribution भी provide कर सकती है।
Unfit Buildings: Scheme में human habitation के लिए unfit building का closure, demolition हो सकता है। Obstructive buildings भी demolish किए जा सकते हैं।
Infrastructure: Scheme में roads, private streets, street lighting, water supply, drainage, sanitation, communication, open spaces का provision किया जा सकता है।
Social Justice Provision: Scheme में prescribed extent तक land reserve किया जा सकता है: SC, ST, Backward Classes, Weaker Sections, Disabled/Handicapped, Mentally Retarded Persons, Unassisted Elderly Persons के housing accommodation के लिए।
Environmental Improvement: Scheme में Environmental improvement से संबंधित works भी लिए जा सकते हैं।
Draft Scheme में क्या होगा? Draft project/scheme में: Original plot का area, Ownership, Tenure, Reserved/allotted land, Proposed use, Plot boundaries में proposed alteration, Net cost estimate, Scheme details, Layout/re-layout, Low-lying/swampy area reclamation आदि दिए जाएंगे।
20. SECTION 174 — Scheme Preparation
Municipality resolution द्वारा किसी Development Area में project/scheme बनाने की intention declare कर सकती है।
30 Days Rule: Declaration of intention के 30 days के भीतर Municipality को declaration Official Gazette में publish करना होगा।
Draft Scheme — One Year: Declaration के बाद Not later than 1 year Municipality को draft project/scheme तैयार करके publish करना होगा।
Objection Period: Draft scheme के notice में objections/suggestions के लिए date Publication से कम-से-कम 30 days के बाद की होनी चाहिए।
Hearing: Municipality objections/suggestions consider करेगी और affected persons को reasonable opportunity of being heard देगी।
Final Scheme: Approval के बाद Municipality Official Gazette और prescribed other manner में Final Project/Scheme publish करेगी। और operation date specify करेगी।
Special Exception: यदि scheme Municipality में vested land पर execute हो रही है और कोई building demolition या persons removal involved नहीं है, तो Section 174 की सामान्य procedure follow करना आवश्यक नहीं है।
21. SECTION 175 — Redevelopment Scheme
यदि किसी area में buildings: disrepair या unsanitary conditions के कारण habitation के लिए unfit हैं, या: streets narrow/badly arranged, inadequate light, inadequate air, poor ventilation, lack of conveniences से health को खतरा है, तो CMO Redevelopment Scheme frame कर सकता है।
Redevelopment का Objective: Existing Streets + Buildings का Re-arrangement and Reconstruction करना।
22. SECTION 176 — Scheme Approval
CMO द्वारा framed development scheme Municipality को approval के लिए submit होगी। Municipality: Approve, Modify या Reject कर सकती है। Reject करने पर CMO को directions के अनुसार fresh scheme तैयार करनी होगी।
23. SECTION 177 — Scheme के बाद Restriction
Draft scheme publish होने के बाद उस area में कोई व्यक्ति land/building का use institute/change या development नहीं कर सकता, जब तक Municipality की Necessary Permission न मिले।
Village Abadi Exception: Village abadi limits में Gram Panchayat द्वारा दी गई permission के अनुसार development किया जा सकता है, लेकिन वह Draft Scheme/Scheme के consistent होना चाहिए।
Sections 166–172 लागू: Approved scheme पर Sections 166–172 mutatis mutandis लागू होते हैं। Mutatis mutandis — म्यूटेटिस म्यूटैंडिस — आवश्यक बदलावों के साथ।
24. SECTION 178 — Scheme Lapse
Approved scheme को publication की date से 2 years के भीतर implement नहीं किया गया, तो Scheme lapse हो जाएगी।
Formula: Scheme → 2 Years → Otherwise Lapse
25. SECTION 179 — Withdrawal
Municipality inquiry के बाद Official Gazette notification से project/scheme Withdraw कर सकती है। Withdrawal के बाद further proceedings नहीं होंगी।
Scheme Modification: यदि modification scheme/project के character में material alteration नहीं करता, तो Municipality suitable modification कर सकती है।
26. SECTION 180 — State Government Direction
Municipality scheme बना सकती है। लेकिन यदि State Government requires तो Municipality को CMO को direct करना होगा कि वह Development Scheme तैयार करे।
27. SECTION 181 — Plan के बाहर Scheme
यह एक महत्वपूर्ण exception है: यदि Municipality की opinion में कोई project/scheme necessary या public interest में expedient है, तो वह Sanctioned Plan में covered न होने के बावजूद project/scheme बना सकती है। उस extent तक Plan deemed modified माना जाएगा।
28. SECTION 182 — Change of Land Use
अब Chapter का अत्यंत महत्वपूर्ण provision: Change of Land Use (CLU)
Basic Rule: Municipal area में कोई person land का use original allotted/sold purpose से अलग नहीं कर सकता। या Master Plan के contrary use नहीं कर सकता, जहाँ Master Plan operative है।
Unallotted/Unsold Land: यदि land allotted/sold नहीं था; Section 182(1) में covered नहीं है; तो Act के commencement से पहले जिस purpose के लिए land use हो रहा था: उससे अलग purpose में use नहीं किया जा सकता।
Change of Use कौन Allow कर सकता है? State Government या State Government द्वारा Official Gazette notification से authorised authority change of use allow कर सकती है।
Conditions for CLU: Change of use Public Interest में होना चाहिए। और Conversion Charges pay करने होंगे। साथ ही Neighbourhood objections invite और hear किए जाएंगे, prescribed manner में।
Permitted Change Categories — Section 182(3) में:
1. Residential → Commercial/Other
2. Commercial → Other
3. Industrial → Commercial/Other
4. Cinema → Commercial/Other
5. Hotel → Commercial/Other
6. Tourism → Commercial/Other
7. Institutional → Commercial/Other
Conversion Charges: Conversion charges अलग-अलग area और अलग-अलग purpose के लिए अलग rates पर हो सकते हैं।
Unauthorized CLU का Regularization: यदि authority को लगता है कि permission/regularization आवश्यक था लेकिन person ने apply नहीं किया, और permission grant/regularization possible है, तो authority notice + hearing के बाद Conversion Charges determine कर सकती है।
Special Protection — Public Purpose Land: यदि original land use Education, Medical, Charitable purpose जैसे public purpose के लिए था, और land concessional rate पर allotted था, तो सामान्यतः land-use change regularization नहीं होगा। Exception: Original allotment rate और prevailing rate का difference pay किया जाए और Original allotting authority की specific consent मिले।
Conversion Charges कहाँ जाएंगे? Section 182 के तहत प्राप्त Conversion Charges का credit Municipality Fund में होगा।
Conversion Charges की Recovery: Conversion charges liable person's interest in land पर First Charge होंगे। और Arrears of Land Revenue के रूप में recover होंगे।

3. SECTION 157 — Metropolitan Planning Committee
When Metropolitan Area? Where Population = 10 lakh or more, Metropolitan Planning Committee (MPC) shall be constituted.
Exam Formula: MPC = 10 Lakh+
Main objective of MPC: MPC prepares the draft of Metro Region Development Plan for the entire Metropolitan Area.
Members of MPC: The number of members in MPC is determined by State Government from time to time through Official Gazette notification.
MPC — 2/3 Rule — most important MCQ fact: At least 2/3 members of MPC shall be elected. These elected members are chosen from elected members of Municipalities and Chairpersons of Panchayats in the Metropolitan Area.
Formula: MPC → ≥ 2/3 Elected
Representation of Elected Members: The ratio of representation of Municipal areas and Panchayats shall be based on their respective population.
Nominated Members: Nominated members may include: representatives of Government of India, representatives of State Government, representatives of organisations/institutions identified by State Government.
Special Rule for Central Government Representative: If a nominated person represents Government of India or a Central Government organisation/institution, prior concurrence of Government of India shall be obtained before nomination.
Functions of MPC: MPC may be assigned functions related to Planning and Coordination. These functions may be assigned by State Government.

4. SECTION 158 — District Planning Committee
As per Section 158: The District Planning Committee constituted under Section 121 of Rajasthan Panchayati Raj Act, 1994 shall be deemed to be the committee constituted under Article 243ZD of the Constitution.

5. SECTION 159 — Civic Survey
For planned and integrated development and balanced land use, Municipality shall conduct Detailed Civic Survey. On this basis, Master Development Plan and Other Statutory Plans are prepared.
Coordination with whom? Municipality shall coordinate with: Metropolitan Planning Committee or District Planning Committee. And with Chief Town Planner of the State.

Master Development Plan: Master Plan is a long-term spatial/development framework. It includes planning for Municipality's future development, public utilities, civic amenities, housing, transportation, natural resources, etc.
Execution Plan — Time Horizon: 5 years: It is a medium-term framework that operationalises implementation of the Master Development Plan.
Annual Municipal Action Plan — Time Horizon: 1 year: This is the annual implementation/action level planning document.
Ward-Level Plans: In addition to Master Development Plan, Execution Plan and Annual Municipal Action Plan, Municipality may prepare other plans for each ward. Or State Government may direct to do so.
What is included in Master Development Plan? The Plan may precisely define: Roads, Highways, Railways, Canals, Airports/Air Cargo, Bus Services, Water Supply, Drainage, Sewerage, Electricity/Gas, Natural Areas, City Forests, Wildlife, Historical/Architectural/Scientific Sites, Housing, Recreation, Industrial concentration, Redevelopment, etc.
Zoning: Master Development Plan may divide Municipality into various zones. For each zone, manner of development, land use, and development stages may be specified.
Zonal Development Plan: Master Development Plan serves as a basic framework. Based on this, Zonal Development Plans for various zones may be prepared.
Zone Alteration: Municipality may alter the area of any zone if deemed necessary in Public Interest.
Financial Resources Limitation: Inclusion of a scheme in Master Development Plan does not mean that Municipality must implement it immediately. Municipality may undertake schemes considering the availability of its financial resources.
6. SECTION 160 — Draft Plan
Before making the Final Plan, a Draft Plan shall be prepared. Then a copy shall be made available for inspection. And through public notice, Objections + Suggestions shall be invited.
Advisory Committee: Municipality may constitute an Advisory Committee if deemed appropriate. Its function is to consider the draft plan.
Advisory Committee — Composition:
1. All Municipality Members
2. Representatives of Industry/Commerce/Trade/Profession associations
3. 6 representatives from Academic institutions
4. 6 representatives from NGOs
5. 6 representatives from other prominent citizens
Important Number — 6–6–6
Final Approval: After considering objections, suggestions, representations and Advisory Committee recommendations, Municipality sends the Plan to State Government for approval.
7. SECTION 161 — When will Plan Operate?
After sanction of Plan, Public Notice shall be published. That notice shall state: Plan is approved; where Plan can be inspected. And Plan shall come into operation from the date of first publication.
Exam Trap: Plan operation is not necessarily State approval date. Statutory trigger: First publication of public notice
8. SECTION 162 — Plan Modification
After Plan comes into operation, Municipality may make modification with prior approval of State Government. But modification shall not make material alteration in character. And shall not relate to land-use extent or population density standards.
Before Modification: Municipality shall publish notice and consider objections/suggestions.
When will Modification operate? Modification may operate from publication date or date fixed by Municipality in notice.
But Final Approval? Important point of Section 162(5): No modification without final approval of State Government.
9. SECTION 163 — Implementation
After Plan comes into operation, Municipality may initiate necessary action to implement the Plan, subject to provisions of the Act.
10. SECTION 164 — Old Plans
Any Master Development Plan made under any other law before commencement of this Act shall be deemed to have been prepared under this Act. But when a Plan sanctioned under this Act comes into operation, the old Plan shall cease to operate.
11. SECTION 165 — Review of Plan
Within 10 years from the date of operation of Plan, if State Government or Municipality considers revision necessary, State Government may direct Municipality to revise. Or Municipality may suo motu revise.
At time of Revision: If necessary, fresh civic survey and existing land-use map may be prepared.
Formula: Plan Review → 10 Years
12. SECTION 166 — Development Area
After Plan comes into operation, Municipality may, with State Government approval, by Official Gazette notification declare any area as Development Area.
Basic Rule in Development Area: After notification, no person shall institute/change use of land or carry out development without written permission of Municipality.
Development Area — Exceptions: Permission is not required for certain activities. Examples: Internal maintenance/improvement of building when external appearance is not materially affected. Compliance with lawful authority order, statutory works of Municipality, certain road/highway/public utility works of Government/local authority, ordinary excavation/wells in agricultural operations, agricultural access road, normal use of temporary use, occasional alternative use of normally used land.
13. SECTION 167 — Unauthorized Development
If any person carries out development/use: without required permission or contrary to conditions of permission or after permission is revoked or contrary to modified permission, then offence is committed.
Section 167 — First Category Penalty: On conviction, fine up to ₹5,000 and for continuing offence, additional fine up to ₹100 per day.
Section 167(2) — Unauthorized Use: If any person continues use of land/building contrary to Plan: on conviction, fine up to ₹2,000 may be imposed. Continuing offence: additional fine up to ₹500 per day.
Important Difference:
Unauthorized Development → ₹5,000 + ₹100/day
Unauthorized Use → ₹2,000 + ₹500/day

14. SECTION 168 — Removal Notice
In case of unauthorized development, Municipality may give written notice to the owner. Notice may give a period of up to Maximum 1 month for compliance.
Purpose of Notice: As per situation: Restore unauthorized development to prior condition or secure compliance with permission/conditions. If notice is for discontinuance of land use, notice shall also be given to occupier.
What can be in Notice? Municipality may require: Demolition, Alteration, Building/other operations, Discontinuance of land use.
Owner's Remedy: Person aggrieved by notice may, within prescribed period, apply for retention permission or continuance of use permission. Until the application is finally decided/withdrawn, mere notice does not by itself affect building/use.
If permission is granted? If requested permission is granted, Notice shall be withdrawn to the relevant extent.
If permission is not granted? Notice shall Continue and Municipality may take required corrective action.
15. SECTION 169 — Unauthorized Development Discontinuance
Under Section 169, Municipality may take action to discontinue unauthorized development. Police assistance is also available in statutory mechanism and continued unauthorized development may attract additional consequences.
Continuing Offence: If unauthorized development continues even after police requisition, on conviction: Fine up to ₹5,000 and continuing offence: additional fine up to ₹200/day.
No Compensation: No claim for compensation for damage caused due to discontinuance of unauthorized development.
16. SECTION 170 — Temporary Unauthorized Development
For temporary unauthorized development, Municipality may by written order direct removal of structure/work or discontinuance of unauthorized land use.
15 Days Rule: In case of temporary unauthorized development, a period of 15 days is given. If person does not comply, Municipality/authorized officer may summarily remove/discontinue.
Standing Crops Protection: In removal of temporary unauthorized development, Standing crops shall not be summarily removed. A reasonable period, up to Maximum 6 months, may be given for cutting/gathering the crop.
Who will decide “Temporary Development”? Under Section 170, Municipality's decision as to whether development is of a temporary nature or not is Final.
17. SECTION 171 — Plot Subdivision
If any person wishes to subdivide his land/plot or lay out a Private Street, after Plan comes into operation, the Layout Plan must be submitted to Municipality for sanction.
What can Municipality do? Municipality may: Sanction or Modified sanction or Sanction with Conditions or Refuse.
Ground for Refusal: If Municipality considers that subdivision/private street is not consistent with Plan proposals, sanction may be refused.
Compensation on Refusal? No compensation — simply refusal of sanction, modification, imposition of conditions do not make compensation payable.
Unauthorized Subdivision: If person works without sanction, contrary to conditions of sanction, or despite refusal of sanction, Municipality may give stop-work notice and after inquiry remove/pull down or restore land.
Section 171 Penalty: If development continues even after notice, fine up to ₹5,000 and continuing non-compliance: additional fine up to ₹200/day.
18. SECTION 172 — Recovery of Expenses
Expenses incurred by Municipality under Sections: 168, 169, 170, 171 shall be Sum due to Municipality. And shall be recovered as Arrears of Land Revenue.
19. SECTION 173 — Projects & Schemes
Municipality may make Projects and Schemes for implementing Plan or otherwise for integrated city development.
Land Acquisition in Scheme: Scheme may include acquisition, development, reservation, sale, lease of land. Public purposes include: Roads, Streets, Parks, Open spaces, Hospitals, Educational institutions, Housing, Markets, Shopping centres, Commercial complexes, Cultural centres, Administrative centres, Transport facilities, etc.
Redistribution in Scheme: Scheme may also provide for Redistribution of sites of original property owners.
Unfit Buildings: Scheme may include closure, demolition of buildings unfit for human habitation. Obstructive buildings may also be demolished.
Infrastructure: Scheme may provide for roads, private streets, street lighting, water supply, drainage, sanitation, communication, open spaces.
Social Justice Provision: Scheme may reserve land up to prescribed extent for housing accommodation of SC, ST, Backward Classes, Weaker Sections, Disabled/Handicapped, Mentally Retarded Persons, Unassisted Elderly Persons.
Environmental Improvement: Scheme may also include works related to Environmental improvement.
What shall be in Draft Scheme? Draft project/scheme shall include: Area of original plot, Ownership, Tenure, Reserved/allotted land, Proposed use, Proposed alteration in plot boundaries, Net cost estimate, Scheme details, Layout/re-layout, Low-lying/swampy area reclamation, etc.
20. SECTION 174 — Scheme Preparation
Municipality may by resolution declare its intention to make project/scheme in any Development Area.
30 Days Rule: Within 30 days of declaration of intention, Municipality shall publish the declaration in Official Gazette.
Draft Scheme — One Year: After declaration, Not later than 1 year, Municipality shall prepare and publish draft project/scheme.
Objection Period: In notice of draft scheme, date for objections/suggestions shall be at least 30 days after publication.
Hearing: Municipality shall consider objections/suggestions and give reasonable opportunity of being heard to affected persons.
Final Scheme: After approval, Municipality shall publish Final Project/Scheme in Official Gazette and in prescribed other manner. And specify date of operation.
Special Exception: If scheme is being executed on land vested in Municipality and no building demolition or removal of persons is involved, the general procedure of Section 174 need not be followed.
21. SECTION 175 — Redevelopment Scheme
If in any area buildings are unfit for habitation due to disrepair or unsanitary conditions, or streets are narrow/badly arranged, inadequate light, inadequate air, poor ventilation, lack of conveniences posing health risk, then CMO may frame Redevelopment Scheme.
Objective of Redevelopment: Re-arrangement and Reconstruction of existing Streets + Buildings.
22. SECTION 176 — Scheme Approval
The development scheme framed by CMO shall be submitted to Municipality for approval. Municipality may: Approve, Modify or Reject. On rejection, CMO shall prepare a fresh scheme as per directions.
23. SECTION 177 — Restriction after Scheme
After draft scheme is published, no person in that area shall institute/change use of land/building or carry out development without Necessary Permission of Municipality.
Village Abadi Exception: In village abadi limits, development may be carried out as per permission given by Gram Panchayat, but it shall be consistent with Draft Scheme/Scheme.
Sections 166–172 apply: On approved scheme, Sections 166–172 shall apply mutatis mutandis. Mutatis mutandis — with necessary changes.
24. SECTION 178 — Scheme Lapse
If approved scheme is not implemented within 2 years from date of publication, the Scheme shall lapse.
Formula: Scheme → 2 Years → Otherwise Lapse
25. SECTION 179 — Withdrawal
Municipality may, after inquiry, Withdraw project/scheme by Official Gazette notification. After withdrawal, further proceedings shall not be held.
Scheme Modification: If modification does not make material alteration in character of scheme/project, Municipality may make suitable modification.
26. SECTION 180 — State Government Direction
Municipality may make scheme. But if State Government requires, Municipality shall direct CMO to prepare Development Scheme.
27. SECTION 181 — Scheme outside Plan
This is an important exception: If in Municipality's opinion any project/scheme is necessary or expedient in public interest, it may make project/scheme even if not covered in Sanctioned Plan. To that extent, Plan shall be deemed modified.
28. SECTION 182 — Change of Land Use
Now the most important provision of this Chapter: Change of Land Use (CLU)
Basic Rule: No person in municipal area shall use land for any purpose other than the original allotted/sold purpose. Or use contrary to Master Plan, where Master Plan is operative.
Unallotted/Unsold Land: If land was not allotted/sold; not covered under Section 182(1); then it shall not be used for any purpose other than the purpose for which land was being used before commencement of the Act.
Who can allow Change of Use? State Government or authority authorised by State Government by Official Gazette notification may allow change of use.
Conditions for CLU: Change of use shall be in Public Interest. And Conversion Charges shall be paid. Also, Neighbourhood objections shall be invited and heard, in prescribed manner.
Permitted Change Categories — in Section 182(3):
1. Residential → Commercial/Other
2. Commercial → Other
3. Industrial → Commercial/Other
4. Cinema → Commercial/Other
5. Hotel → Commercial/Other
6. Tourism → Commercial/Other
7. Institutional → Commercial/Other
Conversion Charges: Conversion charges may be at different rates for different areas and different purposes.
Regularization of Unauthorized CLU: If authority finds that permission/regularization was required but person did not apply, and permission grant/regularization is possible, authority may after notice + hearing determine Conversion Charges.
Special Protection — Public Purpose Land: If original land use was for public purpose like Education, Medical, Charitable purpose, and land was allotted at concessional rate, then generally land-use change regularization shall not be done. Exception: If difference between original allotment rate and prevailing rate is paid and specific consent of original allotting authority is obtained.
Where will Conversion Charges go? Conversion Charges received under Section 182 shall be credited to Municipality Fund.
Recovery of Conversion Charges: Conversion charges shall be First Charge on liable person's interest in land. And shall be recovered as Arrears of Land Revenue.
